Terms of Service

Geogram - Live Map or Application it’s mobile application, subject to the following Terms of Service or TOS (as amended from time to time, the “Terms of Service”) Please read these terms of service carefully, as they contain an important information regarding your legal rights, remedies, and obligations. When using our application, you accept this agreement and EULA (https://geo-live.web.app/docs/basic-documents/eula), you will be subject to any additional terms applicable to such services that may be posted on the this TOS from time to time, including, without limitation, the Privacy Policy located at (https://geo-live.web.app/docs/basic-documents/privacy-policy). All such terms are hereby incorporated by reference into these Terms of Service.

Who can use our mobile application#

If you are under the age of 18, you may not create an account or use the Application. In addition, you must be at least the age at which you can access personal information in accordance with the laws of your country.

By using the Application, you confirm that you have the right to enter into a legally binding contract with Application and that you agree to these Terms and applicable local, federal and personal laws, rules and regulations.

Your profile#

To use our Application, you need to create an account or profile. Here are some important profile information:

  • Nickname, photo, birthday and optional profile’s information.

  • When you create an entry, we ask to choose a unique nickname and upload any photo of you. It will be displayed while using the app. We ask your birthday to check our age policy. You can also choose optional information like: a simple name (for example your real first or last name) , who you want to find (girlfriend, boyfriend or just friend), some lifestyle description about you and others.

  • Phone number and confirmation.

  • You need a valid phone number to create an account. So that no one else can create an account with your number, we will ask you to confirm it when creating a record. To do this, google auth service sent you an SMS with a confirmation code to your phone number. You need to enter a verification code in the Application to complete your registration. Your account is linked to your phone number, so if you want to continue using the Application, do not lose it. If the phone number is unavailable, then you will no longer be able to use the Application.

Geoposition#

The main value of Application is real time geoposition of you. Therefore, in order to provide the Application properly, we need access to your location data. And we store them. You should understand that anyone who use Application is able to find you around, but there is some settings or premium features which can do your location invisible or hide you in some cases. We will request access to your device's location data upon registration. But you can disable and re-enable access to location data at any time in the settings of your device.

Notifications#

You can turn on notifications to find out when you get some geo requests about knowing your geoposition from users or get reactions on you or get notifications about created events or notifications about received messages.

Account security.#

Once you have created your Application account, you accept full responsibility for any actions you take with it. Our Application does not ask for a password, please try to keep your phone safe. And don't give it to anyone if you don't want them to use your account. If you think that someone managed to hack your account or used it for fraudulent purposes, immediately write to us at geogramlive@gmail.com We will try to respond as quickly as possible.

Geolocation service#

The Application is a geolocation service. In order to provide the Services, the Application requires access to the location data of your device. Also, the Application saves some of the places you have visited. You need to allow the Application to access geolocation data via iOS device settings. The location of your device will be transmitted when the app is active or in the background, unless you have selected otherwise in the device or Application settings.

If you want to stop transferring geolocation data, do it at any time in the device settings. If you disable the transmission of geolocation data through the device settings, you will not be able to use the Application.

Location accuracy depends on many factors, such as mobile network coverage, connection stability, and so on.

Geogram - Live Map is a social network. This means that by default we share your location with everyone around you, unless we change the settings - on the device or in the application itself.

To provide the Services, we need to store your geolocation data for the entire time during which you use the Services. You can find out more about the periods of storage and deletion of information in our Privacy Policy.

The maps on which we show you in the Application belong to third parties. Therefore, it may turn out that some geographic areas have not yet been properly processed or changed, so the maps do not display, for example, new or renamed streets, etc.

Your rights#

It is prohibited to copy, modify, distribute, sell or rent any part of our Services. Also, you must not decompile or attempt to extract the source code of the software, unless local laws prohibit such restrictions or you have our written permission.

Confidentiality#

How your information is processed when using the Application, see the Privacy Policy. Read it very carefully.

Respect for the rights of others#

We respect the rights of others. The user has to do this too. You cannot use the Application or allow others to do so if such actions are:

  • violation or infringement of someone's rights to private and public life, confidentiality, copyright, trademarks or other intellectual property
  • intimidation, insult or provocation
  • spreading slander
  • the spread of spam or intrusive behavior

Respect our rights:

  • use branding, logo, design, photography, video or any other materials used in our Application
  • copy, archive, download, distribute, publish, broadcast, perform, demonstrate, make available or otherwise use any part of the Application or their materials, except as specified in these Terms
  • use the Services, any provided tools or any of their materials for commercial purposes without our permission

Security#

Our Services are secure for all users, but this is not guaranteed. By using the Services, you agree that you will not:

  • use the Services for any purposes illegal or prohibited by these Terms
  • use any bots, collectors, spies or any other types of automated access to the data of the Services or information of other users
  • use or develop third-party applications that will interact with the Services or materials or information of other users without our written permission
  • use the Services in a manner that will interfere, distract, negatively affect or impede the access of other users to the full range of Services, or harm, disable, overload or in any other way interfere with the operation of the Services
  • use or attempt to use another user's account without permission
  • post materials that contain pornography, scenes of violence, threats, hate speech or calls for violence and reprisals
  • upload viruses or other types of malware or otherwise threaten the security of the Services
  • attempt to bypass any media filtering technologies we have implemented or access areas or features of the Services for which you are not authorized
  • study, scan, or verify the vulnerabilities of our Services or other systems and networks
  • encourage or provoke any activity that violates these Terms
  • never use the App while driving

Third party services#

If you use a service, feature or function provided by third-party services and made available through our Services (including the Services provided in conjunction with third parties), then your relationship with each of the parties is governed by the relevant terms. We are not responsible for the terms of the third party or the actions taken by it.

Modification of the Services and termination of their provision#

We can add or remove a feature, product, or feature. We may also suspend or completely terminate the provision of the Services. Each of these actions can be taken at any time, in which case we will try to warn you in advance that it will not work, but this is not always possible.

At any time and for any reason, you can opt out of these Terms by deleting your account. You can do this by writing to us at geogramlive@gmail.com

Geogram - Live Map may also do this on its part if you fail to comply with these Terms, laws, or for any reason beyond our responsibility. We will warn you in advance, we cannot guarantee this. Our right to terminate these Terms means that we will no longer provide the Services to you or we will introduce new or additional restrictions on your right to use the Services. For example, if you stay idle long enough (12 months), your account will be disabled.

Regardless of the party initiating the termination of the Terms, you and we must continue to follow this Terms.

Disclaimer#

You agree that, within the framework established by law, you will not blame us and our employees for any complaints, fines, claims, damages, losses, costs, debts and expenses (including expenses for attorneys' fees) arising in connection with (or what - or otherwise related to):

  • your access to the Services or their use
  • our materials
  • Your breach of these Terms

We strive to keep the Services working properly, but we cannot guarantee this.

The Services are provided "as is" and "as possible" and in accordance with the laws without warranties of any kind, either expressed or implied, including expressly implied warranties, conditions or other terms related to (i) suitability for commercial use , satisfactory quality, suitability for a certain purpose, right of ownership, unimpeded use, non-infringement or (ii) arising from normal business practice. In addition, while Geogram - Live Map’s goal is to provide a user-friendly experience, we do not represent or warrant that: (a) the Services will always be safe, free from errors, or provided in a timely manner; (b) Services will always be provided without delays, business interruptions or deviations; (c) any materials or information obtained through the Services will be timely or accurate.

IF THE LAW OF THE COUNTRY OF YOUR RESIDENCE DOES NOT ALLOW THE EXCLUSIONS STATED IN THIS CLAUSE, THEY WILL NOT APPLY.

We are not responsible or liable for any material that you, other users or third parties create, upload, post, send, receive or store through our Services. You understand and agree that you may come across materials that you find offensive, illegal, misleading, or in any other way unacceptable; in this case, we are not responsible for this.

Nothing in these Terms will exclude or limit any of our liability for the removal of materials if required by the laws of the country in which you live.

Limitation of Liability#

We are not responsible for any indirect, incidental, special, consequential, punitive or multiple damages, or any loss of profit or income that occurs directly or indirectly, as well as any loss of data, usage information, loss of reputation or other intangible property that occurs in as a result of: (a) your use of the Services or your inability to do so; (b) your access or inability to access the Services; (c) the behavior or materials of other users or third parties transmitted through the Services; (d) unauthorized access, use or modification of your materials. Under no circumstances will we be liable in any way in the event of claims regarding the use of the Services when the amount of such claims is more than 50 euros.

IF THE LAWS OF THE COUNTRY OF YOUR RESIDENCE DO NOT ALLOW THE LIMITATIONS OF LIABILITY STATED IN THIS CLAUSE, THESE LIMITATIONS DO NOT APPLY.

Dispute Resolution#

Exceptional venue#

As part of the resolution of litigation established by these Terms, both you and we agree that decisions on claims and disputes (contractual or otherwise) related to these Terms or the use of the Services or arising from them will be considered exclusively in the courts of the Russian Federation, except in situations where it is prohibited by the laws of your country of residence. You and we agree to the exclusive jurisdiction of these courts.

Applicable law#

These Terms and any claims and disputes (contractual or otherwise) related to or arising from these Terms or the subject of their consideration are governed by Russian Federation law. In some countries, courts may not accept Russian Federation law in certain disputes related to the Terms. If you live in such a country, disputes will be resolved within the framework of its legislation.

Independence of provisions#

If any provision of these Terms is found to be unenforceable, then it will be excluded from these Terms and this will not affect the validity and enforceability of any remaining provisions.

Final Terms#

These Terms constitute the entire agreement between you and Geogram - Live Map and supersede any prior agreements. These Terms do not create or grant any beneficial interest to third parties. If we do not enforce any provision of these Terms, this will not be considered a waiver. We reserve all rights that have not been expressly granted to you. You will not be able to transfer any rights or obligations under these Terms without our consent.
